Update note on the GDPR:
The server log files were previously stored for a maximum of 190 days and then deleted. The data was stored for security reasons, e.g. to be able to clarify cases of misuse. If data had to be retained for reasons of proof, it was or will be excluded from deletion until the incident has been finally clarified or is still under investigation. With the introduction of the GDPR, we no longer store log files and have deactivated this function on the server side via our provider.

Purposes and legal bases of data processing

We process personal data in accordance with the provisions of the European General Data Protection Regulation (EU GDPR), the German Fiscal Code (AO) and the Hessian Data Protection and Freedom of Information Act (HDSIG).

Processing for the performance of a task carried out in the public interest, Art. 6 (1) (e), (3) EU GDPR

We require personal data in order to fulfill our sovereign tasks of uniformly determining and collecting taxes in accordance with the provisions of the Tax Code, the Municipal Tax Act and the relevant tax and other laws, the Code of Civil Procedure and municipal statutes and enforcing them on the basis of the Administrative Enforcement Act.

Other municipal departments also collect personal data, which is transmitted to the city treasury, the tax and trade office for further processing (accounting, payment transactions and collection). If you have any questions about the scope of this data, please contact the relevant department.

The personal data is processed in the administrative procedure for which it was collected. Only in the cases expressly permitted by law may we also process the personal data collected to carry out a procedure for other purposes.

Processing on the basis of consent, Art. 6 (1) (a) EU GDPR

If consent has been given for the processing of personal data for specific purposes (e.g. account data as part of a SEPA direct debit mandate or for refunds), the legal basis for the processing of this data is the consent given.

Processing for the fulfillment of legal obligations, Art. 6 para. 1 lit. c) EU GDPR

In addition, we also process personal data to fulfill statutory retention obligations in accordance with the municipal budget ordinance and the tax code.

Type of personal data

We process the following personal data in particular:

First and last name, address and, if applicable, contact details such as telephone number, e-mail address, cash register number, bank details, company or other business or company name, commercial register number, first and last name of the (legal) representative(s), the authorized representative(s), the managing director(s), the shareholder(s), tax number.

Information required for the determination and collection of property and business taxes, e.g.

Trade tax assessment amount, assessed value and property tax assessment amount, apportionment share of the trade tax or property tax assessment amount, type of property, information on taxes and advance payments made or refunded, interest and other ancillary claims, information on applications submitted and legal remedies.

As a rule, we collect personal data from the data subjects themselves, e.g. through declarations, applications and forms.

In the case of land tax and trade tax, we receive the personal data via the assessment notices and apportionment notices from the responsible tax office and process these further.

In addition, we collect personal data from third parties insofar as they are legally obliged or authorized to notify us, such as local courts (commercial, association and trade registers, land register), asset registers at the Central Enforcement Courts, Federal Central Register, tax offices, residents' registration authorities, trade offices and regulatory authorities

or if the data subjects have given the third party their consent to the transfer of data.

If we are unable to clarify a matter with the help of the data subject or if an inquiry is unsuccessful, we may also collect the personal data concerned by making inquiries with third parties (e.g. tax offices, Federal Central Tax Office, SCHUFA Holding AG).

We may also process publicly accessible information, e.g. from public registers or public announcements.

Disclosure of your data to third parties

With regard to the transfer of data, we are subject to tax secrecy in accordance with Section 30 AO, data protection in accordance with the provisions of the EU GDPR and the HDSIG.

We may only pass on the personal data collected by us or of which we become aware to other persons or bodies (e.g. authorities in the context of requests for administrative assistance or in legal remedy proceedings, courts, the Federal Central Tax Office, law enforcement authorities) if such disclosure is permitted by law.

Type of data processing

The processing of personal data in the largely automated levy procedure is mostly carried out in automated procedures for the assessment and collection of levies and other claims. We use technical and organizational security measures to protect personal data against accidental or unlawful alteration, destruction or loss and against unauthorized disclosure or access.

We only make legally binding decisions on the basis of "fully automated" processing of personal data if this is permitted by law, e.g. for the "fully automated tax assessment notice" in accordance with Section 155 (4) of the Tax Code, Section 4 of the Hesse Municipal Tax Act (HKAG).

Duration of storage of your personal data

The personal data is stored for as long as is necessary for the respective procedure. The criteria for this are, in particular, the limitation periods under tax law pursuant to Sections 169 - 171 of the German Fiscal Code (AO), Section 4 of the Hesse Municipal Fees Act (HKAG), Section 19 of the Hesse Administrative Costs Act (HVwKostG), Section 53 (2) of the Hesse Administrative Procedure Act (HVerwVfG), Sections 195, 197 of the German Civil Code (BGB).

The personal data in question may also be stored in order to process it for future proceedings under tax law (Section 88a AO, Section 4 HKAG) and in enforcement proceedings (Section 17a HVwVG).

Furthermore, your data will be stored to fulfill statutory retention obligations in accordance with the German Fiscal Code (§§ 146 - 148 AO) and the Municipal Budget Ordinance (§ 37 GemHVO). The periods specified there are up to 10 years.

Your data protection rights

According to the EU General Data Protection Regulation (GDPR), every data subject has the right of access, rectification, erasure, restriction of processing and objection with regard to their personal data. In addition to the EU GDPR, Sections 32c to 32f AO also apply to real taxes.

There is no right to data portability in accordance with Art. 20 EU GDPR, as the processing of personal data is necessary for the performance of a task carried out in the public interest or in the exercise of official authority, Art. 20 para. 3 EU GDPR.

Right to information, Art. 15 EU GDPR

Data subjects have the right to request information about whether and which of their personal data we process. They may also request information about the information referred to in Art. 15 (1) (a) - (h).

The request for information should specify the request in order to make it easier for us to compile the necessary data. The request should therefore include details of the specific administrative procedure (e.g. type of tax and year) and the stage of the procedure (e.g. assessment, enforcement).

Right to rectification, Art. 16 EU GDPR

If the data concerned are not (or no longer) accurate or incomplete, the data subjects have the right to request that the data be rectified and completed.

Right to erasure, Art. 17 EU GDPR

Data subjects may request the erasure of their personal data if processing by us is unlawful for the reasons stated in this provision.

However, deletion cannot be requested if the processing is necessary to fulfill a legal obligation, Art. 17 para. 3 EU GDPR, in particular in the following cases:

the data is still required for the purpose of processing,

the legal basis for the processing continues to exist,

the statutory retention periods are still running.

Right to restriction of processing, Art. 18 EU GDPR

Under the conditions specified in this provision, data subjects can request the restriction of processing (blocking), e.g. prevent the deletion of their data because it is required for the assertion or defense of legal claims.

Right to object, Art. 21 EU GDPR

Data subjects have the right to object to processing on grounds relating to their particular situation. However, we cannot comply with this if there is an overriding interest in further processing or if a legal provision obliges us to continue processing (e.g. implementation of the submission procedure).

Right to lodge a complaint, Art. 77 EU GDPR

Every data subject also has the right to lodge a complaint with the competent supervisory authority if they believe that the processing of their personal data violates the GDPR or that we have not complied with their request or have not complied with it in full.
